Preamble

These Terms and Conditions (hereinafter referred to as "T&Cs") govern the contractual relationship between TravelTribe GmbH, a company duly registered under the laws of Switzerland with its registered office at Erlachstrasse 46, 8003, Zurich, Switzerland (hereinafter referred to as "TravelTribe", "we", "us", or "our") and any individual or legal entity (hereinafter referred to as "Customer", "you", or "your") who books or participates in any travel services, events, or experiences offered by TravelTribe. By booking any service with TravelTribe, you acknowledge that you have read, understood, and agree to be bound by these T&Cs.

1. Scope of Services

TravelTribe GmbH operates as a travel agency specializing in the organization and provision of various travel-related services, including but not limited to:

  • Arranging and booking accommodation, transportation (flights, trains, buses, car rentals, etc.), and other travel-related services.
  • Organizing and conducting events, tours, excursions, and other experiences (hereinafter referred to as "Experiences").
  • Providing information and advice regarding travel destinations, requirements, and related matters.
  • Acting as an intermediary between Customers and third-party service providers (e.g., hotels, airlines, activity providers).

The specific details of each Experience, including the itinerary, inclusions, exclusions, price, and any specific conditions (including cancellation and refund policies), will be outlined on the respective Experience page on our website or in other promotional materials provided by TravelTribe.

2. Booking and Confirmation

2.1. Booking Process: Bookings can be made only through our website. When making a booking, you are responsible for providing accurate and complete information for all participants, including full names as they appear on passports or identification documents, dates of birth, contact details, and any special requirements or requests.

2.2. Offer and Acceptance: Your booking request constitutes an offer to enter into a contract with TravelTribe for the selected services. A contract is formed only when your booking is confirmed by TravelTribe in writing (e.g., via email), subject to the availability of the services and your acceptance of these T&Cs.

2.3. Group Bookings: For group bookings, the person making the booking is responsible for ensuring that all members of the group agree to these T&Cs and for providing all necessary information for each participant.

3. Payment Terms

3.1. Prices: The prices for our services are as displayed on our website or quoted by our representatives and are generally stated in Swiss Francs (CHF), unless otherwise specified. Prices are subject to change without prior notice until a booking is confirmed.

3.2. Payment Schedule: The required deposit or full payment schedule will be specified at the time of booking and may vary depending on the type of service booked and the time of booking relative to the departure date or event date.

3.3. Payment Methods: We accept various payment methods, which will be indicated during the booking process. These may include bank transfers, credit cards, and other online payment options.

3.4. Late Payment: If payment is not received by the due date, TravelTribe reserves the right to cancel the booking without further notice and without any liability for any loss or damage incurred by the Customer. Any cancellation fees as outlined in Section 5 will apply.

3.5. Currency Fluctuations: For bookings where prices are quoted in a currency other than CHF, the final amount charged may be subject to fluctuations in exchange rates at the time of payment.

3.6. Additional Charges: Unless explicitly stated, prices do not include any additional charges such as visa fees, airport taxes, baggage fees, optional excursions, gratuities, personal expenses, or any other costs not specifically mentioned in the service description.

4. Changes and Cancellations by TravelTribe GmbH

4.1. Changes to Bookings: While we strive to operate all our services as advertised, TravelTribe reserves the right to make changes to the itinerary, schedule, accommodation, transportation, or other aspects of an Experience or travel arrangement at any time if deemed necessary due to unforeseen circumstances, including but not limited to weather conditions, natural disasters, political instability, security concerns, supplier issues, or any other events beyond our reasonable control (hereinafter referred to as "Force Majeure Events").

4.2. Notification of Changes: We will endeavor to notify Customers of any significant changes as soon as reasonably practicable. If a significant change is made to an Experience or travel arrangement before departure or the event date, you may have the option to:

  • Accept the change;
  • Accept a comparable alternative service offered by TravelTribe (if available); or
  • Cancel your booking and receive a refund of the amounts paid to TravelTribe for that specific service, subject to deduction of reasonable administrative costs.

4.3. Cancellation by TravelTribe: TravelTribe reserves the right to cancel an Experience or travel arrangement at any time due to Force Majeure Events or if the minimum number of participants required for an Experience is not met (as specified on the Experience page). In the event of cancellation by TravelTribe for reasons other than Force Majeure Events, you will be offered the options mentioned in Section 4.2. If the cancellation is due to Force Majeure Events, we will endeavor to provide a refund of the amounts paid to TravelTribe, less any non-refundable deposits or charges imposed by third-party suppliers.

4.4. No Compensation for Minor Changes: Minor changes to the itinerary or other aspects of the service that do not significantly affect the overall experience do not entitle the Customer to any compensation or the right to cancel without incurring cancellation fees.

5. Customer Cancellations and Changes

5.1. Cancellation by Customer: If you wish to cancel your booking, you must follow the procedure outlined on the website. The cancellation policy applicable to your specific booking will be as specified on the Experience page or otherwise communicated to you at the time of booking.

5.2. Refund Policy: Refunds for cancellations initiated by the Customer are strictly bound by the conditions specified on the Experience page for the particular service you have booked. These conditions may include, but are not limited to, the amount of notice given, the type of service, and any non-refundable components (e.g., certain transportation tickets or accommodation costs). Please carefully review the specific refund policy applicable to your booking before confirming.

5.3. Changes by Customer: Requests for changes to a confirmed booking (e.g., changes to dates, participants, or services) are subject to availability and may incur additional charges imposed by TravelTribe or third-party suppliers. TravelTribe will endeavor to accommodate reasonable requests for changes, but we cannot guarantee that changes can be made.

5.4. No Refund for Unused Services: No refunds will be provided for any unused portion of a service once it has commenced, including but not limited to missed flights, accommodation, meals, or activities, unless otherwise agreed upon in writing by TravelTribe.

6. Liability Waiver and Assumption of Risk

6.1. Acknowledgement of Risks: By participating in any Experience or travel service organized by TravelTribe, you acknowledge and understand that travel and participation in events and activities inherently involve risks, some of which may be significant and could result in personal injury, illness, property damage, or even death. These risks may arise from various factors, including but not limited to:

  • Transportation accidents (e.g., vehicle collisions, aircraft incidents, train derailments).
  • Adverse weather conditions, natural disasters (e.g., earthquakes, floods, landslides).
  • Encounters with wildlife.
  • Accidents during activities such as hiking, swimming, climbing, water sports, or other physical activities.
  • Exposure to infectious diseases or illnesses.
  • Political instability, civil unrest, or acts of terrorism.
  • The actions or omissions of third-party service providers.

6.2. Voluntary Participation: You confirm that your decision to participate in the Experience or travel service is voluntary and that you have had the opportunity to make an informed decision after considering the potential risks involved.

6.3. Full Liability Waiver: To the fullest extent permitted by applicable Swiss law, you hereby expressly and irrevocably waive, release, and discharge TravelTribe GmbH, its directors, officers, employees, agents, representatives, and subcontractors (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, damages, losses, expenses, and liabilities of any kind or nature whatsoever, whether known or unknown, foreseen or unforeseen, arising out of or in any way connected with your participation in any Experience or travel service organized by TravelTribe, including but not limited to any injury, illness, death, or loss or damage to personal property, regardless of whether such claims are based on negligence, breach of contract, breach of warranty, or any other legal theory, except in cases of gross negligence or willful misconduct on the part of TravelTribe.

6.4. Assumption of Responsibility: You acknowledge and agree that you are solely responsible for your own safety and well-being during the Experience or travel service and that you will take all necessary precautions to protect yourself from potential risks. You are responsible for ensuring that you are physically and mentally fit to participate in the activities involved and that you have the necessary skills and knowledge.

6.5. Compliance with Instructions: You agree to comply with all instructions and guidelines provided by TravelTribe representatives or third-party service providers during the Experience or travel service. TravelTribe reserves the right to refuse participation to anyone who fails to comply with these instructions or whose conduct is deemed unsafe or disruptive to others.

7. Insurance

TravelTribe strongly recommends that all Customers obtain comprehensive travel insurance that covers medical expenses, personal accident, loss of baggage, trip cancellation, curtailment, and other potential risks associated with travel and participation in the booked Experience. It is your responsibility to ensure that you have adequate insurance coverage for the duration of your trip. TravelTribe shall not be liable for any costs or losses incurred by you due to inadequate or lack of insurance coverage.

8. Health and Safety

8.1. Health Requirements: It is your responsibility to ensure that you are aware of any health requirements or recommendations for your chosen destination and to take all necessary precautions, including vaccinations, as advised by your doctor or relevant health authorities.

8.2. Pre-existing Medical Conditions: If you have any pre-existing medical conditions that may affect your ability to participate in the Experience or travel service, you must inform TravelTribe at the time of booking and provide any necessary medical information. We reserve the right to refuse your participation if we reasonably believe that your health condition may pose a risk to yourself or others.

8.3. Dietary Requirements: Please inform us of any dietary requirements or allergies at the time of booking. While we will endeavor to accommodate your requests where possible, we cannot guarantee that all dietary requirements can be met by third-party service providers.

8.4. Safety During Experiences: During Experiences, you are responsible for your own safety and for using any equipment provided in a safe and responsible manner. You must follow the instructions of our guides and any safety regulations provided.

9. Data Protection

TravelTribe is committed to protecting your privacy. Any personal data provided by you will be processed in accordance with the applicable Swiss data protection laws and our Privacy Policy, which is available on our website. By booking our services, you consent to the collection, processing, and use of your personal data for the purposes of fulfilling your booking, providing you with information about our services, and complying with legal obligations.

10. Intellectual Property

All content included on our website, in our promotional materials, and during our Experiences, including but not limited to text, graphics, logos, images, videos, and software, is the property of TravelTribe GmbH or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any of our intellectual property without our prior written consent.

11. Governing Law and Jurisdiction

These T&Cs shall be governed by and construed in accordance with the laws of Switzerland, excluding its conflict of laws rules. The exclusive place of jurisdiction for any disputes arising out of or in connection with these T&Cs shall be the competent courts in Zurich, Switzerland.

12. Severability

If any provision of these T&Cs is held to be invalid, illegal, or unenforceable for any reason, such provision shall be struck out, and the remaining provisions shall continue in full force and effect as if the invalid, illegal, or unenforceable provision had never been included.

13. Amendments to the Terms and Conditions

TravelTribe reserves the right to amend these T&Cs at any time without prior notice. The latest version of the T&Cs will be posted on our website. It is your responsibility to review the T&Cs periodically for any changes. By continuing to use our services after any amendments have been made, you agree to be bound by the revised T&Cs.

Acknowledgement

By proceeding with a booking with TravelTribe GmbH, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. You further acknowledge that you have had the opportunity to seek independent legal advice regarding these T&Cs before entering into a contract with TravelTribe.
